1 Purpose
These T&Cs are intended to define the conditions under which SublimeIA provides its optimisation, retouching and enhancement services for property photographs intended for seasonal and short-term rentals (Airbnb, Booking, etc.).

These Terms and Conditions (hereinafter "T&Cs") govern the contractual relationship between SublimeIA and any natural or legal person (hereinafter the "Client") wishing to use the property photography optimisation services offered by SublimeIA.
Any order implies unreserved acceptance of these T&Cs, which take precedence over any other document from the Client, and in particular over any general purchasing conditions.
These T&Cs are intended to define the conditions under which SublimeIA provides its optimisation, retouching and enhancement services for property photographs intended for seasonal and short-term rentals (Airbnb, Booking, etc.).
SublimeIA offers the following services:
The prices for services are indicated in euros (€) inclusive of all taxes (incl. VAT) on the website www.sublimeia.com and in quotes provided to the Client.
The prices in force on the day of the order apply. SublimeIA reserves the right to modify its prices at any time, without affecting orders already validated.
Purchases are made in the form of photo credits. 1 Credit = 1 photo.

Payment is made:
Payment is due upon ordering credits.
Card payments are secured via Stripe or PayPal. SublimeIA does not store any banking data.
In the event of payment default, SublimeIA reserves the right to suspend or cancel the order without notice.
Optimised photos are delivered:
In the event of a delay attributable to SublimeIA, the Client will be informed as soon as possible. A delay cannot give rise to order cancellation or penalties, except by exceptional agreement. However, if it is an express order, the express option will be refunded in the form of a credit.
In accordance with applicable consumer law, the right of withdrawal cannot be exercised for services fully performed before the end of the withdrawal period and whose performance began with the prior express agreement of the consumer.
By validating their order, the Client expressly accepts that SublimeIA begins performing the service before the expiry of the 14-day withdrawal period.
Once the optimised photos have been delivered, the right of withdrawal can no longer be exercised.
The Client guarantees that they own or hold the usage rights to the photographs they submit to SublimeIA.
Once payment has been made, the Client becomes the owner of the optimised photographs and may use them freely for their rental listings.
The Client authorises SublimeIA to use the optimised photos (in before/after format) in its portfolio, on its website and for commercial communication, unless the Client expressly requests otherwise.
The Client undertakes not to:
Personal data collected (name, first name, email, phone, address) is necessary for order processing and service provision.

In accordance with the GDPR, the Client has the right of access, rectification, deletion and objection to the processing of their personal data.

These T&Cs are governed by French law.
In the event of a dispute, the parties undertake to seek an amicable solution before any legal action.

In accordance with applicable consumer law, the Client has the right to use a consumer mediator free of charge for the amicable resolution of the dispute.
Failing amicable resolution, the dispute will be brought before the competent courts in accordance with the rules of common law.
